TERMS & CONDITIONS OF HIRE & FREIGHT

The following terms & conditions apply to individuals and entities (the Customer) using &/or hiring Communication Services &/or Equipment, including but not exclusively Iridium, Inmarsat, Cospas Sarsat & Starlink (and SpaceX) Satellite Communications Services provided by GlobalSat Pty Ltd (ABN 12 067 562 314).

Hire of equipment & services from us, you agree to be bound by the following GlobalSat Pty Ltd Terms & Conditions. The Customer understands & accepts that all Equipment and/or Services remains the property of GlobalSat Pty Ltd. The customer will not lend, transfer hire, sell or anything thereof, any part of the Equipment and/or services under any circumstance. The customer may not use or permit another person to use the service in a fraudulent manner or to commit a criminal offence. The Customer agrees to provide reasonable co-operation in any investigation of unlawful use of Services and/or Equipment.

The Customer acknowledges that GlobalSat Pty Ltd takes care to ensure that all Equipment is in correct working order prior to dispatch. GlobalSat Pty Ltd will accept no liability, nor pay compensation, for failure of the Equipment at any given time, or failure of the network or connection to the network. It is the Customers responsibility to read through any instruction manual(s) provided & test all equipment prior to leaving for their trip & advise GlobalSat of any & all issues. GlobalSat shall bear no responsibility for failure of Customers not understanding the functionality of any Equipment and/or Service. GlobalSat utilize the Iridium, Inmarsat, Cospas Sarsat & Starlink Satellite Networks & other satellite/terrestrial networks as appropriate to the hardware offered at the time. Communication services may be temporarily unavailable or limited for a number of reasons beyond GlobalSat's direct control, & as such, GlobalSat shall not be liable to the Customer, nor shall the Customer make any claim against GlobalSat or its Suppliers, for any damage, loss of property, opportunity or earnings, personal injury, death or any other loss whatsoever sustained by the unavailability, delay, faultiness or failure of the Satellite Network and/or Equipment.

Starlink In-motion use of Mobile Data is limited to less than 16kmph and is not guaranteed.

STARLINK ACCEPTABLE USER POLICY
Mobile Regional and Mobile Global (available on "Roam" and "Maritime") service plan users will have the ability to opt in to Mobile Priority data as you need it on a per GB basis in order to use designated Starlink hardware in motion. In-motion use of Mobile Data is limited to less than 16kph.

This Acceptable Use Policy (“AUP”) describes the acceptable use by you of GlobalSat’s two-way satellite-based Starlink internet service (“Services”) and the related equipment (“Starlink Kit”). The AUP is a material part of your Hire & Services agreement with GlobalSat (“Service Terms”). The AUP allows GlobalSat & Starlink to provide its customers with the best Services possible while also complying with the laws and regulations governing use of the internet. BY USING THE SERVICES YOU AGREE TO BE BOUND BY AND COMPLY WITH THE AUP.
AUP VIOLATION EXAMPLES. The following are examples of conduct which may lead to the suspension or termination of your Services: (1) accessing without permission or right the accounts or computer systems of others, spoofing the URL, DNS or IP addresses of Starlink, GlobalSat or any other entity, penetrating the security measures of Starlink or any other person’s computer system, or attempting any of the foregoing: (2) transmitting uninvited communications, data or information, or engaging in other similar activities, including without limitation, “spamming”, “flaming”, and denial of service attacks; (3) intercepting, interfering with, or redirecting email or other transmissions sent by or to others; (4) introducing viruses, worms, harmful code, or Trojan horses on the Internet; (5) engaging in conduct that is defamatory, fraudulent, obscene, or deceptive; (6) violating Starlink’s or any third party’s copyright, trademark, proprietary, or other intellectual property rights; (7) engaging in any conduct harmful to the Starlink network, the Internet generally, or other Internet users; (8) using the Services or Starlink Kit to violate any GlobalSat rule, policy, or guideline; (9) using the Services or Starlink Kit in any fashion for the transmission or dissemination of images containing child pornography or in a manner that is obscene, sexually explicit, cruel, or racist in nature, or which espouses, promotes, or incites bigotry, hatred, or racism; or (10) downloading or using the Services in or Starlink Kit in violation of other International Trade Controls described in the Service Terms.
THIRD PARTY INTELLECTUAL PROPERTY INFRINGEMENT. GlobalSat respects the intellectual property rights of third parties. You may not store any material or use the Services or the Starlink Kit in any manner that constitutes an infringement of third party intellectual property rights, including, for example, under copyright law. Pursuant to Section 512 of the Digital Millennium Copyright Act, it is Starlink’s policy to terminate the account of repeat copyright infringers in appropriate circumstances. In addition, GlobalSat & Starlink expressly reserves the right to suspend, terminate, or take other interim action regarding the Services if, in its sole judgment, GlobalSat & Starlink believes that circumstances relating to an infringement of third party intellectual property rights warrant such action.
EXCESSIVE USE OF NETWORK RESOURCES. GlobalSat reserves the right to engage in reasonable network management to protect the overall network, including analyzing traffic patterns to optimize services and preventing the distribution of viruses or other malicious code. GlobalSat & Starlink reserves the right to immediately restrict, suspend, or terminate Services without notice in order to protect the network or minimize congestion caused by unauthorized use.
AUP ENFORCEMENT AND NOTICE. Failure to observe the restrictions and guidelines associated with this AUP may result in GlobalSat taking actions that may range from a warning to a suspension or termination of Services. GlobalSat reserves the right to act immediately and without notice to restrict, suspend or terminate Services, if it determines that your conduct may: (1) expose GlobalSat & Starlink to sanctions, prosecution, civil action or other liability; (2) cause harm to or interfere with the integrity or normal operations of GlobalSat’s Services or any network(s) with which GlobalSat is interconnected; (3) interfere with another GlobalSat customer’s use of the Services; (4) violate any applicable law, rule, or regulation, including, but not limited to, copyright or any other intellectual property infringement; or (5) otherwise present an imminent risk of harm to GlobalSat or its customers. In the event of the termination of Services by reason of the violation of this AUP, all applicable Starlink Kit charges will apply. Except as expressly provided herein, the rights and remedies of GlobalSat are cumulative and not exclusive of any rights or remedies that GlobalSat may otherwise have at law or in equity.
REVISIONS AND RESERVATION OF RIGHTS. GlobalSat reserves all rights, including the right to revise, amend or modify this AUP and any other GlobalSat policy at any time, in accordance with the Service Terms. Such changes will become effective on the date GlobalSat sends them to you or posts them to the website. Your continued use of the Services will constitute your acceptance of any such changes to the AUP or other GlobalSat policy. If you do not wish to continue Services after a change, you may terminate Services at any time, in writing, in accordance with the Service Terms.

Receiving by Pickup:
If you are collecting the hire equipment from our store
Please be aware that applicable hire fees commence on the day the equipment is collected from our store in West Ipswich, Queensland during our standard business hours unless other arrangements have been made and approved by GlobalSat management. Your hire period will commence on the day you collect the equipment.

Receiving by Delivery:
If you wish the equipment to be delivered, All hire kits are dispatched 2 business days prior to your first day of hire – Example: Hire from Friday, we ship your order Wednesday. This is normally ample time to get the kits to most metro areas as we use express services however, we always suggest hiring a day or two before your departure date to ensure the kit arrives in time. If you know your area can have extended delivery times, please consider adding additional days to your hire and also letting our team know. Your last day of hire is the day your hire kit is shipped back to us.

Returning by Drop-Off:
Your last day of hire is the day the equipment is returned by you to our store.

Large orders may incur additional shipping charges which are quoted on a case by case basis.

Returning by AusPost or Courier:
The hire period will end the day you handover the equipment to AusPost or a courier. We will verify this by the Date Stamp or the from the courier.
If you are planning to ship the equipment back to us, please let us know. You must use an express courier service and we suggest sending EXPRESS POST from your local Post Office to avoid any further hire fees - we provide 2 business days grace for hire return via an express service. You will be charged additional hire fees (at the applicable day rate) for any returns that run past the 2 day grace period.

Airtime Charges:
Subject to standard calls and/or SMS to landlines or mobiles WITHIN AUSTRALIA.

Calls are charged at $2.80 per min or part thereof.
e.g.,
a 60 second call will cost $2.80
a 61 second call will cost $5.60
a 120 second call will cost $5.60
a 121 second call will cost $8.40

SMS / text messages are $1.25 per 160 character text message.
- 9505A = 160 characters per SMS.
- 9555, 9575, Iridium GO! up to 960 characters per SMS, charged in 160 character increments.
eg:
up to 160 character SMS = $1.25
161 - 320 character SMS = $2.50
321 - 480 character SMS = $3.75
481 - 640 character SMS = $5.00
641 - 800 character SMS = $6.25
801 - 960 character SMS = $7.50

Calls & SMS to other satellite services and international numbers will be charged at higher rates of which are applicable to the service or location called.
