4.3 If Equipment is delivered by freight, courier or post, the Hire Period begins on the date stated in the booking confirmation. GlobalSat may dispatch Equipment before the first day of hire to assist with delivery timing, but this does not change the agreed Hire Period unless otherwise stated.

Additional hire charges may apply where the return exceeds the grace period or where a non-express, untracked or unsuitable return method is used.
5.7 Freight and Large Orders
5.7.1 Large orders, bulky items, remote deliveries, urgent deliveries, international freight, special handling or multi-kit bookings may incur additional freight, handling or insurance charges, quoted on a case-by-case basis.
6. Payment Terms
6.1 Unless GlobalSat has approved business credit terms in writing, all hire charges must be paid in advance by credit card or another approved payment method.
6.2 A valid credit card may be required to secure the booking and must remain valid throughout the Hire Period and until all hire, usage, damage, loss, late return, freight and other charges have been finalised.
6.3 By providing card details, the Customer authorises GlobalSat to charge the card for:
agreed hire charges;

repair or replacement costs for lost, stolen, damaged or incomplete Equipment;
bank, card, merchant, chargeback or dishonour fees where legally recoverable; and
any other amounts payable under these Terms.
6.4 GlobalSat will act reasonably when charging additional amounts and may provide an invoice, statement or supporting usage record where applicable.
6.5 The Customer must not initiate a card chargeback or payment dispute without first making reasonable efforts to resolve the issue directly with GlobalSat. This does not limit any rights the Customer may have under law.
6.6 If a chargeback, reversal or dishonour occurs and the relevant amount remains properly payable, the Customer remains liable for the unpaid amount and any reasonable recovery costs incurred by GlobalSat.
6.7 Approved business customers must pay invoices within the agreed payment terms. If payment terms are not met, GlobalSat may withdraw credit approval, require prepayment for future hire, suspend Services where lawful and reasonable, or commence recovery action.
7. Deposits, Pre-Authorisations and Security

7.2 A security deposit or pre-authorisation may be applied toward unpaid hire charges, Airtime Charges, late return fees, loss, theft, damage, cleaning, missing accessories, freight or other amounts payable under these Terms.
7.3 If the Equipment is returned on time, complete, clean, undamaged and with no outstanding usage or other charges, the deposit or pre-authorisation will be released or refunded within a reasonable time.
7.4 Release of a bank or card pre-authorisation may take additional time depending on the Customer’s bank or card provider.
8. Customer Responsibilities
8.1 The Customer must:
use the Equipment safely, lawfully and only for its intended purpose;
ensure all users are competent and have read the supplied instructions;
inspect and test the Equipment before departure or before relying on it in a remote, emergency or international setting;
notify GlobalSat immediately if any Equipment is missing, damaged, malfunctioning or unsuitable;
keep the Equipment secure and protected from loss, theft, impact, water damage, heat, dust, corrosion, misuse and unauthorised access;
comply with all applicable laws, permits, telecommunications rules, customs rules, aviation, maritime and land transport rules, export controls and destination-country requirements;
ensure the Equipment is not used for unlawful, fraudulent, abusive, offensive, dangerous or prohibited purposes;
not sell, lend, transfer, sub-hire, pledge, dispose of, modify, open, tamper with, repair, unlock, reconfigure or reverse-engineer the Equipment;
not remove labels, asset tags, SIM cards, antennas, batteries, warning stickers or instructions unless GlobalSat gives written approval;
return the Equipment complete, clean, undamaged and in the supplied case or packaging; and
cooperate reasonably with GlobalSat in relation to any investigation of loss, damage, misuse, illegal use, network abuse, emergency activation or disputed charges.
9. Testing Before Use
9.1 Satellite and emergency communication equipment should be tested before departure and before entering remote, isolated, marine, international or high-risk areas.
9.2 The Customer must read the supplied quick-start guide, instructions and any relevant network guidance before relying on the Equipment.
9.3 The Customer must notify GlobalSat as soon as possible if:
the Equipment does not power on;
the Equipment cannot register on the network;
a satellite phone cannot make a test call;
a Starlink terminal cannot connect, activate, update, align or provide internet access;
a PLB or emergency device appears damaged, expired, incorrectly labelled or unsuitable; or
any accessory, charger, cable, SIM, antenna, case or documentation appears to be missing.
9.4 If the Customer does not test the Equipment before departure or before entering an area where alternative communications are unavailable, GlobalSat may not be responsible for problems that could reasonably have been identified and addressed before use, subject always to the Customer’s non-excludable rights under law.
10. Satellite Service and Network Limitations
10.1 The Customer acknowledges that satellite communication services are not guaranteed and may be unavailable, delayed, degraded, interrupted or limited for reasons outside GlobalSat’s control.
10.2 Factors that may affect Equipment or Service performance include:
satellite network availability;
account activation or plan status;
sky visibility and obstruction;
buildings, terrain, vegetation, cliffs, valleys, tunnels, vehicle structures or marine structures;
weather, rain fade, atmospheric conditions or solar activity;
local interference;
satellite beam coverage or capacity;
congestion or network management;
power supply limitations;
device damage, low battery or incorrect setup;
software or firmware updates;
third-party outages;
emergency services or search and rescue response limitations;
international restrictions, roaming limitations or country-specific service rules; and
user operation, incorrect dialling, incorrect setup or failure to follow instructions.
10.3 GlobalSat does not own or control the satellite networks used by the Equipment and is not responsible for the acts, omissions, outages, limitations, restrictions, policies or coverage decisions of Third-Party Network Providers.
10.4 The Customer must not rely on any single device or satellite network as the only means of communication where loss of communication may create a serious safety risk. The Customer should consider appropriate redundancy, including additional communication devices, spare batteries, power options, trip plans, emergency contacts and location-sharing procedures.
11. Emergency Use, Safety and No Sole Reliance
11.1 Satellite phones, PLBs and Starlink terminals can support remote communication and emergency preparedness, but they do not remove the need for proper planning, risk assessment, training, supervision, backup communication methods or emergency procedures.
11.2 The Customer acknowledges that the Equipment and Services are not guaranteed to operate at all times, in all locations, in all conditions or during every emergency. The Equipment and Services may fail, be delayed, be unavailable or be unable to connect due to hardware faults, battery or power issues, incorrect setup, lack of satellite visibility, obstruction, terrain, weather, network congestion, network outage, account or activation issues, software or firmware issues, international restrictions, emergency service limitations, or other circumstances outside GlobalSat’s reasonable control.
11.3 The Customer must not rely on any single item of Equipment, satellite network or communication service as the sole means of emergency communication where failure of communication may create a risk of injury, death, property loss or operational harm. The Customer is responsible for adopting suitable redundancy and safety procedures, which may include carrying more than one communication method, spare batteries or power supplies, written trip plans, check-in procedures, emergency contacts, location-sharing procedures and other risk controls suitable for the activity, destination and level of risk.
11.4 The Customer is responsible for testing the Equipment before departure and before entering any remote, international, marine, aviation, disaster response, high-risk or emergency-dependent environment. The Customer must notify GlobalSat immediately if the Equipment does not operate as expected, so that GlobalSat has a reasonable opportunity to assist, troubleshoot, replace, reconfigure or advise on alternative arrangements before the Customer relies on the Equipment.
11.5 GlobalSat does not provide emergency monitoring services unless expressly agreed in writing.
11.6 GlobalSat is not responsible for the availability, timing, conduct or outcome of emergency services, search and rescue services, police, ambulance, aviation, maritime, land rescue, private recovery operators or any other emergency response authority, except to the extent required by law.
12. International Use
12.1 The Customer must disclose any intended international travel or use outside Australia at the time of booking.
12.2 GlobalSat may require additional information before approving international use, including destination countries, transit countries, vessel or vehicle details, travel dates, user details, emergency contacts and intended use.
12.3 The Customer is responsible for confirming that possession, importation, exportation and use of the Equipment and Services is lawful in each country, territory, airport, port, vessel, border crossing or transit location where the Equipment will be taken or used.
12.4 Some countries restrict, regulate, require permits for, or prohibit satellite phones, satellite terminals, encryption devices, tracking devices, emergency beacons, Starlink terminals or other communication equipment. The Customer is responsible for obtaining all required approvals, permits, licences, customs clearances and travel authorisations.
12.5 GlobalSat is not responsible for any seizure, confiscation, delay, fine, penalty, investigation, arrest, deportation, customs issue, regulatory action, service block, roaming limitation or inability to use Equipment outside Australia, except to the extent caused by GlobalSat’s negligence, wilful misconduct or breach of law.
12.6 International use may incur higher call, SMS, roaming, data, priority data, maritime, aviation, global, regulatory or network charges. The Customer is responsible for all such charges incurred while the Equipment is in the Customer’s possession or control.
12.7 The Customer must notify GlobalSat immediately if Equipment is lost, stolen, seized, confiscated, damaged, detained by customs or otherwise not able to be returned on time while outside Australia.
12.8 Where Equipment is not returned to Australia by the agreed return date due to international travel, border delay, customs delay, airline delay, freight delay, seizure, confiscation or other cause, additional hire charges may continue to apply until the Equipment is returned or replacement costs are paid.
13. Iridium and Inmarsat Satellite Phones and Terminals
13.1 Satellite phones and terminals must be used in accordance with supplied instructions and applicable network requirements.
13.2 The Customer is responsible for all calls, SMS, data sessions, voicemail, emergency calls, test calls, accidental calls, inbound charges, outbound charges, international charges, satellite-to-satellite charges and other usage charges incurred during the Hire Period or while the Equipment is in the Customer’s possession or control.
13.3 Calls may be charged in whole-minute increments or other billing increments depending on the applicable network or service plan. A call that exceeds a billing increment may be charged as the next full increment.
13.4 SMS charges may apply per message segment. Long messages may be split into multiple segments and charged accordingly.
13.5 International calls, satellite-to-satellite calls, premium numbers, maritime calls, aviation calls, calls made or received outside Australia and data sessions may incur higher charges.
13.6 Satellite phones require appropriate sky visibility and correct operation. They may not work indoors, inside vehicles without an external antenna, under dense canopy, in steep terrain, near obstructions or where the satellite network is unavailable or congested.
13.7 The Customer must not remove or swap SIM cards unless GlobalSat gives prior written approval.
14. Starlink Mini Hire Kits
14.1 Starlink Mini terminals and related kits are supplied subject to the applicable Starlink service plan, Starlink terms, Starlink acceptable use requirements, geographic availability, hardware capability, activation status, data limits, priority data limits and network availability.
14.2 Starlink service availability, speeds, latency and performance are not guaranteed. Performance may be affected by obstruction, weather, power supply, network congestion, plan type, data prioritisation, location, firmware updates, account status and Starlink network management.
14.3 The Customer must ensure the Starlink terminal has a suitable view of the sky and is safely positioned, powered and secured.
14.4 The Customer must not operate, mount or position a Starlink terminal in a way that creates a safety hazard, road hazard, aviation hazard, marine hazard, trip hazard, electrical hazard, fire hazard or risk of damage to people, property, vehicles, vessels or the Equipment.
14.5 Use of Starlink in motion is subject to the applicable Starlink service plan, hardware, authorised location, network rules and current Starlink policies. GlobalSat does not guarantee in-motion service availability or performance.
14.6 Data allowances, fair use limits, priority data, plan upgrades, international availability, ocean use, maritime use, global roaming and overage charges may vary depending on the Starlink service plan and current Starlink rules.
14.7 Unless otherwise stated in the booking confirmation, Starlink data is subject to the included data allowance or plan type specified at the time of booking. Overage, priority data, plan upgrade or additional data charges may be charged to the Customer.
14.8 The Customer must not use Starlink Services to:
engage in unlawful, fraudulent, abusive, threatening, defamatory, obscene or harmful conduct;
infringe intellectual property rights;
send spam or unsolicited bulk communications;
introduce malware, viruses or harmful code;
attack, overload, interfere with or compromise any network, device, account or system;
access systems without authorisation;
distribute illegal, exploitative or prohibited material;
breach export controls, sanctions, international trade controls or applicable laws;
resell or share the service commercially without written approval; or
breach any Starlink, SpaceX or GlobalSat acceptable use policy.
14.9 GlobalSat may suspend, restrict or terminate Starlink Services if GlobalSat reasonably believes the Customer’s use may breach law, expose GlobalSat or a Third-Party Network Provider to liability, interfere with network integrity, breach acceptable use requirements, create safety risks or cause harm to other users.
14.10 The Customer is responsible for returning all Starlink kit components, including terminal, router or control equipment, cables, mounts, power supplies, cases, accessories and instructions.
15. PLBs and Emergency Beacons
15.1 PLBs and emergency beacons are for genuine emergency use only where there is grave and imminent danger and other means of communication are unavailable or unsuitable.
15.2 The Customer must not activate a PLB except in a genuine emergency or as expressly instructed by GlobalSat or the relevant authority.
15.3 The Customer must not test a PLB except in accordance with the supplied instructions and only where such testing is permitted.
15.4 The Customer must provide accurate user, trip, vessel, vehicle, destination, itinerary and emergency contact information where requested. Incorrect or incomplete information may delay emergency response.
15.5 The Customer acknowledges that PLB response is managed by search and rescue authorities and depends on satellite detection, beacon condition, GPS acquisition, location accuracy, terrain, weather, response availability and emergency service capability.
15.6 GlobalSat is not responsible for the timing, availability, conduct or outcome of any search and rescue response, except to the extent required by law.
15.7 If a PLB is accidentally activated, the Customer must switch it off immediately if safe to do so and contact the relevant authority as soon as possible. For accidental activation in Australia, the Customer should contact the Australian Maritime Safety Authority on 1800 641 792 or any other current number published by AMSA.
15.8 The Customer must notify GlobalSat as soon as possible after any PLB activation, accidental activation, damage, loss, suspected fault or emergency use.
15.9 The Customer is responsible for any loss, damage, replacement, investigation cost, regulatory cost, penalty, misuse cost or recovery cost arising from negligent, reckless, unlawful or non-emergency use of a PLB, except to the extent caused by GlobalSat’s negligence or breach of law.
16. Freight, Delivery and Return
16.1 GlobalSat may dispatch Equipment before the first hire day to assist with timely delivery.
16.2 Delivery times are estimates only and depend on courier, freight provider, destination, weather, public holidays, remoteness, customs, aviation disruptions and other circumstances outside GlobalSat’s control.
16.3 The Customer should allow sufficient time for delivery before departure, particularly for remote, regional, island, mine site, maritime or international travel.
16.4 If the Customer knows or should reasonably know that delivery to their location may take longer than standard express delivery, the Customer should book additional hire days or arrange earlier dispatch with GlobalSat.
16.5 Unless otherwise agreed, returns by post or courier must use an express, tracked service. The Customer must keep proof of lodgement and tracking details.
16.6 The Customer must pack the Equipment securely for return using the supplied case, satchel, packaging or other suitable protection.
16.7 The Customer is responsible for loss or damage during return freight unless GlobalSat arranged and controlled the return freight service.
16.8 If Equipment is returned late because the Customer used a non-express, untracked, unsuitable or delayed return method, additional hire charges may apply.
16.9 Large, bulky, high-value or multi-kit orders may incur additional freight, handling, insurance or delivery charges, which may be quoted separately.
17. Collection and Drop-Off
17.1 Equipment may be collected from GlobalSat’s premises by prior arrangement during business hours.
17.2 Collection outside business hours, on weekends or on public holidays is subject to GlobalSat approval and may incur additional charges.
17.3 Equipment returned by drop-off must be returned during business hours unless GlobalSat approves an alternative arrangement in writing.
17.4 Equipment left unattended, left outside, left with an unauthorised person or returned without GlobalSat’s approval remains the Customer’s responsibility until GlobalSat confirms receipt.
18. Loss, Theft, Damage and Missing Items
18.1 The Customer is responsible for the Equipment from the time it is collected, delivered or otherwise made available to the Customer until it is returned to and received by GlobalSat.
18.2 The Customer must notify GlobalSat immediately if Equipment is lost, stolen, damaged, seized, confiscated, exposed to water, dropped, crushed, overheated, tampered with, misused or otherwise compromised.
18.3 If Equipment is stolen, the Customer must report the theft to police and provide GlobalSat with a police report number as soon as reasonably possible.
18.4 The Customer must not attempt repairs or allow any third party to inspect, open, repair, modify or replace parts without GlobalSat’s prior written approval.
18.5 The Customer is liable for reasonable repair or replacement costs for lost, stolen, damaged or incomplete Equipment, up to the full current replacement value of the Equipment and accessories.
18.6 Where an item cannot be economically repaired, is not returned, is water damaged, is materially damaged, is unsafe, is inoperable, has been tampered with or is beyond reasonable commercial repair, GlobalSat may charge the Customer the replacement value.
18.7 Replacement value may include the cost of replacing the item, accessories, freight, configuration, testing, activation, administration and any other reasonable costs associated with returning GlobalSat to the position it would have been in had the Equipment been returned complete and undamaged.
18.8 The Customer remains liable for hire charges while damaged Equipment is not returned or while replacement arrangements are unresolved, except where the damage or fault was caused by GlobalSat or was not the Customer’s responsibility under law.
19. Cleaning and Return Condition
19.1 Equipment must be returned in a clean and reasonable condition, allowing for fair wear and tear.
19.2 GlobalSat may charge a reasonable cleaning fee if Equipment is returned excessively dirty, contaminated, wet, muddy, sandy, oily, dusty, corroded, affected by smoke, biosecurity matter or otherwise requiring cleaning beyond normal handling.
19.3 The Customer may be liable for replacement costs if contamination, corrosion, water ingress, chemical exposure, salt exposure or other condition makes the Equipment unsafe, unreliable or unsuitable for future hire.
20. Device Cover or Damage Waiver
20.1 GlobalSat may offer optional device cover, damage waiver or similar protection for some hire Equipment.
20.2 Any device cover is subject to the specific terms, exclusions, limits and claim process stated at the time of booking.
20.3 Unless expressly stated otherwise, device cover does not cover:
loss or theft;
intentional, reckless or unlawful conduct;
water damage, salt water exposure or corrosion;
unauthorised repairs or modifications;
confiscation or seizure;
missing accessories;
SIM misuse or usage charges;
late return charges;
international regulatory issues;
damage caused by failure to follow instructions; or
any other excluded item stated in the relevant device cover terms.
20.4 Device cover does not limit any rights the Customer may have under the Australian Consumer Law.
21. Airtime, Data and Usage Charges
21.1 The Customer is responsible for all Airtime Charges incurred during the Hire Period or while the Equipment is in the Customer’s possession or control.
21.2 Airtime Charges may include:
outbound calls;
inbound calls where charged by the relevant network;
SMS and long SMS segments;
voicemail retrieval;
data sessions;
background data;
Starlink data overage;
Starlink priority data;
international roaming;
satellite-to-satellite calls;
premium, maritime, aviation or international numbers;
emergency calls where charged by the network;
activation, reactivation, suspension or plan change fees; and
other usage-based charges applied by a Third-Party Network Provider.
21.3 Call, SMS and data records may not be available immediately. GlobalSat may issue final usage invoices after the Equipment has been returned and after relevant records are received from Third-Party Network Providers.
21.4 The Customer must pay all valid usage invoices even if the charges are received or invoiced after the Hire Period has ended.
21.5 GlobalSat may charge Airtime Charges according to the rates stated in these Terms, the booking confirmation, quote, invoice, published rate card or applicable service plan.
21.6 If no specific rate is stated, the Customer must pay GlobalSat’s standard applicable rate for the relevant service at the time the usage is incurred.
22. Prohibited Use
22.1 The Customer must not use, or allow anyone else to use, the Equipment or Services:
for any unlawful, fraudulent, criminal, harmful or abusive purpose;
to harass, threaten, defame, abuse, deceive or harm another person;
to access, transmit, store or distribute illegal, exploitative or prohibited material;
to infringe intellectual property rights;
to interfere with, disrupt, overload or compromise any network, system, account or device;
to send spam, malware, viruses or harmful code;
to bypass security, authentication, geofencing, network management or service restrictions;
in breach of sanctions, export controls, international trade controls or destination-country laws;
in a way that creates a safety risk, road risk, aviation risk, marine risk, electrical risk or fire risk;
for resale, sub-hire or commercial redistribution without GlobalSat’s written approval;
in a way that breaches any Third-Party Network Provider’s terms, fair use policy or acceptable use policy; or
in any way that may expose GlobalSat, its suppliers or network providers to legal, regulatory, financial or reputational risk.
23. Suspension or Restriction of Services
23.1 GlobalSat may suspend, restrict or terminate Equipment or Services where GlobalSat reasonably believes:
the Customer has breached these Terms;
payment has not been made when due;
the Equipment has been lost, stolen, damaged, misused, seized or compromised;
the Customer has provided false or misleading information;
continued service may create a safety, legal, network, regulatory or security risk;
a Third-Party Network Provider requires or applies suspension, restriction or termination;
the Customer’s use breaches acceptable use, fair use, export control, sanctions or international restrictions; or
suspension is necessary to prevent loss, damage, misuse or unlawful activity.
23.2 GlobalSat will act reasonably when suspending or restricting Services and, where practicable, will notify the Customer. However, immediate action may be taken where required for safety, legal, security, network integrity or regulatory reasons.
23.3 Suspension or restriction of Services does not affect the Customer’s responsibility for charges already incurred or for returning the Equipment.
24. Privacy, Usage Records and Tracking
24.1 GlobalSat may collect and use Customer information for booking, identification, delivery, service activation, support, billing, debt recovery, safety, emergency, insurance, compliance and equipment management purposes.
24.2 GlobalSat may collect or receive usage records, including call records, SMS records, data usage, service status, device identifiers, SIM identifiers, activation status, approximate usage location, Starlink account information, fault data and network logs from Third-Party Network Providers.
24.3 Some Equipment or Services may include GPS, tracking, location, distress alerting, network registration or service status information. The Customer acknowledges that such information may be collected, transmitted, stored or shared where necessary for service delivery, billing, support, emergency response, compliance, loss prevention or recovery of Equipment.
24.4 The Customer must ensure that any person using the Equipment is aware that usage, service and location-related information may be collected or disclosed as described in these Terms.
24.5 GlobalSat may disclose information to Third-Party Network Providers, emergency services, search and rescue authorities, law enforcement, insurers, payment providers, freight providers, debt recovery providers, professional advisers and regulators where reasonably required or permitted by law.
25. Customer Warranties
25.1 The Customer warrants that:
all information provided to GlobalSat is true, complete and correct;
the Customer has authority to enter into the hire agreement;
the Equipment will only be used by authorised and competent users;
the Equipment will be used safely, lawfully and in accordance with instructions;
the Customer has disclosed any international use;
the Customer has made reasonable enquiries about destination-country restrictions before travelling internationally with the Equipment;
the Customer will pay all charges payable under these Terms; and
the Customer will return the Equipment on time, complete and undamaged, subject to fair wear and tear.
26. Australian Consumer Law
26.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or protection under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
26.2 Where GlobalSat is permitted by law to limit its liability for a failure to comply with a consumer guarantee or other non-excludable obligation, GlobalSat’s liability is limited, at GlobalSat’s option, to one or more of the following:
resupplying the relevant goods or services;
repairing the Equipment;
replacing the Equipment or supplying equivalent Equipment;
paying the cost of repair or replacement; or
refunding the relevant hire or service charges.
26.3 The limitations in this section do not apply where they cannot lawfully apply, including in relation to certain major failures or other non-excludable rights under the Australian Consumer Law.
27. Liability
27.1 To the maximum extent permitted by law, GlobalSat is not liable for loss, damage, cost, claim or expense arising from:
satellite network failure, outage, delay, congestion, restriction or unavailability;
Third-Party Network Provider acts, omissions, terms, policies or service limitations;
incorrect use, failure to test, failure to follow instructions or user error;
lack of sky visibility, obstruction, weather, terrain or environmental conditions;
power failure, flat batteries or unsuitable customer power systems;
international regulatory restrictions, confiscation, seizure, customs delay or country-specific limitations;
emergency response delay, non-response or outcome;
loss of profit, revenue, business opportunity, contract, goodwill, production, data or anticipated savings; or
indirect, consequential or special loss.
27.2 Nothing in these Terms limits liability for death, personal injury, fraud, wilful misconduct or any liability that cannot lawfully be excluded or limited.
27.3 The Customer acknowledges that the hire charges are calculated on the basis that the Equipment and Services are supplied with the limitations, exclusions and risk allocation set out in these Terms.
28. Indemnity
28.1 The Customer indemnifies GlobalSat against any loss, damage, liability, claim, fine, penalty, cost or expense suffered or incurred by GlobalSat arising from:
the Customer’s breach of these Terms;
unlawful, negligent, reckless or unauthorised use of the Equipment or Services;
loss, theft, seizure, confiscation, damage or non-return of Equipment;
the Customer’s international travel or failure to comply with destination-country laws;
the Customer’s breach of Third-Party Network Provider terms or acceptable use requirements;
inaccurate, incomplete or misleading information provided by the Customer;
misuse or false activation of a PLB or emergency device; or
claims made by third parties arising from the Customer’s use or possession of the Equipment or Services.
28.2 The Customer’s liability under this indemnity is reduced to the extent that the relevant loss was caused or contributed to by GlobalSat’s negligence, wilful misconduct or breach of law.
29. Cancellations, Early Returns and Refunds
29.1 Cancellation terms may vary depending on Equipment availability, booking type, hire duration, preparation work, freight arrangements, activation costs and the notice given by the Customer.
29.2 GlobalSat may charge reasonable cancellation fees to cover costs already incurred, including freight, activation, testing, configuration, administration, third-party charges and lost hire opportunity.
29.3 If Equipment is returned early, GlobalSat may, at its discretion, provide a refund or credit for unused hire days, less any minimum hire period, activation charges, freight, third-party costs, usage charges, cancellation charges or other applicable costs.
29.4 Refunds will generally be processed to the original payment method unless GlobalSat agrees otherwise.
29.5 Refund processing times may depend on GlobalSat’s payment provider and the Customer’s bank or card provider.
30. Faults and Replacement Equipment
30.1 If Equipment malfunctions during the Hire Period, the Customer must notify GlobalSat as soon as possible and provide details, photographs, error messages, screenshots or other information reasonably requested by GlobalSat.
30.2 The Customer must follow reasonable troubleshooting instructions provided by GlobalSat.
30.3 Where GlobalSat determines that the fault is not caused by Customer misuse, damage, failure to follow instructions, unsuitable power supply, network limitations or circumstances outside GlobalSat’s control, GlobalSat may, where reasonably practicable:
provide troubleshooting support;
suspend or adjust hire charges for the affected period;
provide replacement Equipment;
arrange repair; or
provide a refund or credit for the affected service.
30.4 Replacement Equipment may not be available in all locations, particularly in remote areas, overseas, at sea, in disaster zones or where freight is delayed or unavailable.
31. Ownership and No Security Interest
31.1 The Equipment remains the property of GlobalSat or its supplier at all times.
31.2 The Customer obtains no ownership interest in the Equipment.
31.3 The Customer must not sell, assign, pledge, encumber, lend, sub-hire, transfer, dispose of or create any security interest over the Equipment.
31.4 The Customer must immediately notify GlobalSat if any third party attempts to seize, claim, take possession of or assert rights over the Equipment.
32. Return of Equipment on Demand
32.1 GlobalSat may require immediate return of the Equipment if:
the Customer breaches these Terms;
payment is overdue;
the Equipment is at risk;
the Customer provided false or misleading information;
the Equipment is being used unlawfully, unsafely or outside approved use;
international use was not disclosed or approved;
a Third-Party Network Provider requires return or suspension; or
GlobalSat reasonably considers return necessary to prevent loss, damage, liability or misuse.
32.2 If the Customer fails to return Equipment when required, GlobalSat may take reasonable steps to recover the Equipment and recover reasonable associated costs from the Customer.
33. Force Majeure
33.1 GlobalSat is not liable for delay or failure to perform an obligation where caused by events beyond its reasonable control, including natural disasters, severe weather, fire, flood, cyclone, pandemic, war, terrorism, civil unrest, cyber incident, satellite outage, network outage, power failure, freight disruption, customs delay, government action, labour shortage, supplier shortage or emergency response priority.
33.2 If a force majeure event affects GlobalSat’s ability to supply Equipment or Services, GlobalSat may delay, vary, cancel or refund the booking as reasonable in the circumstances.
34. Disputes
34.1 If a dispute arises, the Customer must contact GlobalSat promptly and provide relevant details, documents, photographs, usage records or other supporting information.
34.2 Both parties agree to act reasonably and attempt to resolve the dispute in good faith.
34.3 The Customer must pay any undisputed amounts when due while a dispute is being reviewed.
34.4 Nothing in this section prevents either party from seeking urgent relief, commencing debt recovery for undisputed amounts, making a complaint to a regulator or exercising rights under applicable law.
35. Changes to these Terms
35.1 The Terms that apply to a hire are the Terms accepted by the Customer at the time of booking, unless the parties agree otherwise.
35.2 GlobalSat may update these Terms from time to time for future bookings.
35.3 GlobalSat will not apply materially adverse changes to an existing confirmed hire unless required by law, required by a Third-Party Network Provider, required for safety or network integrity, or agreed with the Customer.
36. Governing Law
36.1 These Terms are governed by the laws of Queensland, Australia.
36.2 The parties submit to the non-exclusive jurisdiction of the courts of Queensland and the courts competent to hear appeals from those courts.
